Terms of Use

1. Acceptance of Terms

By accessing or using CreativeNode (creativenode.app), you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

CreativeNode is a product of Node Nest Digital Limited, a company registered in Kenya.

2. Service Description

CreativeNode is an AI-powered social media post generator. The service uses artificial intelligence to help users create professional social media designs, flyers, stories, and banners for their businesses and brands.

The service generates both text-based and image-based designs using AI models. Generated content is intended as a starting point and may require review or modification before publishing.

3. User Accounts

To use CreativeNode, you must create an account using a valid email address. Authentication is handled through a passwordless system (email OTP).

  • One account per email address
  • You are responsible for maintaining the security of your email account
  • You must provide accurate and complete information
  • You must be at least 18 years of age to create an account
  • We reserve the right to suspend or terminate accounts that violate these terms

We collect business contact information (business phone, email, website) for display on your generated marketing materials. This is business data voluntarily provided by you for your own marketing purposes, not personal data.

4. Token System

CreativeNode uses a token-based pay-per-use system to manage service usage.

  • Tokens are digital credits used to generate content on the platform
  • Each design generation costs 5 tokens and produces a batch of 6 design variations
  • Each AI caption generation costs 1 token
  • New accounts receive 10 free starter tokens
  • Tokens are non-transferable between accounts
  • Tokens do not expire as long as your account remains active
  • Unused tokens are not redeemable for cash except as outlined in our Refund Policy

5. Payments

Token purchases are processed through third-party payment providers:

  • Paystack for card payments (KES and USD)
  • M-Pesa for mobile money payments (KES only, via STK Push)

Important: CreativeNode does not store your payment card details, M-Pesa PIN, or any other sensitive financial information on our servers. All payment processing is handled securely by our payment partners.

All prices are displayed inclusive of applicable fees. Payments are processed in Kenya Shillings (KES) or US Dollars (USD) depending on the payment method selected.

6. Intellectual Property

Your content: You retain ownership of the designs and content generated through CreativeNode using your inputs and business information. You are free to use, modify, and publish your generated content for any lawful purpose.

Our rights: CreativeNode retains the right to use anonymized, non-identifiable generated content for promotional purposes, service improvement, and showcasing capabilities (e.g., in our gallery). No personally identifiable or brand-specific content will be used without your explicit consent.

Uploaded images: You may only upload product or item images that you own or have the rights to use. Do not upload personal photos, photos of individuals, or images belonging to others. You are responsible for ensuring you have the right to use any images you upload.

Platform: The CreativeNode platform, including its design, code, templates, and branding, is the intellectual property of Node Nest Digital Limited.

7. Acceptable Use

You agree not to use CreativeNode to:

  • Generate illegal, harmful, or threatening content
  • Create content containing hate speech, discrimination, or harassment
  • Produce content that infringes on copyright, trademark, or other intellectual property rights
  • Generate misleading, fraudulent, or deceptive content
  • Create adult, explicit, or sexually suggestive content
  • Attempt to reverse-engineer, exploit, or abuse the service
  • Overload or interfere with the service infrastructure
  • Share your account credentials with others or allow unauthorized access

We reserve the right to remove content and suspend accounts that violate these guidelines without prior notice or refund.

8. Privacy & AI Processing

Your privacy is important to us. Please review our Privacy Policy for detailed information about how we collect, use, and protect your data.

Business contact information and product images you provide are processed by third-party AI processing partners solely to generate your marketing designs. These partners process data per their enterprise API terms and do not retain your data beyond processing or use it for model training.

9. Limitation of Liability

CreativeNode provides AI-generated content as a creative tool. We make no guarantees regarding:

  • The accuracy, completeness, or suitability of generated content for any specific purpose
  • That generated content will be free from errors, biases, or unintended messaging
  • Continuous, uninterrupted, or error-free operation of the service

You are solely responsible for reviewing all generated content before publishing or distributing it. Node Nest Digital Limited shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the service or content generated through it.

Our total liability to you for any claims arising from use of the service shall not exceed the amount you paid for tokens in the 12 months preceding the claim.

10. Modifications to Terms

Node Nest Digital Limited reserves the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting to the website.

For material changes, we will make reasonable efforts to notify registered users via email. Your continued use of CreativeNode after changes are posted constitutes your acceptance of the updated terms.

11. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms or the use of CreativeNode shall be subject to the exclusive jurisdiction of the courts of Kenya.
